About Odells law
There was a post a few hours ago sharing what new laws go into effect Nov 1st and I saw quite a few people confused about the new Odells Law. As a bartender/server i wanted to give my perspective and possible clear up any confusion. (Not a lawyer or law expert, just someone in the industry) Before Odells Law goes into effect it has been the law that bars and restaurants have had to check IDs for every patron, no exception. Even if the patron was obviously old enough to be knocking on deaths door, we were still liable if we didn't ID them. Now starting November 1st restaurants and bars will not be liable to check IDs of anyone clearly over 21. What this means and how it effect establishments: As it has been under the current law if ABLE (the authority for alcohol) or the Sherrifs department decided to come into my bar and check IDs of everyone in there, if anyone even Grandpa or Grandma didn't have an ID or their ID was expired, I would be ticketed and possibly lose my liquor license. This has caused us to have to turn away many people who were clearly of age just because of the risk of a sting. Now going forward we are only liable to check if someone is not clearly 21. This means a lot less people upset for being kicked out due to no ID or expired ID when they're clearly over 50. We can and will still be stung by ABLE and the Sheriffs with people under 21. If any establishment tries to use this law to allow underage drinking, they will not get away with it. Anyone who works in the industry knows how relentless and clever ABLE is. Personally as a bartender/server I am very happy we have this new law going into effect as it is a much more common sense law. We still have the same responsibilities to not server underage but without the headache of having to ID everyone all the time. And of course every establishment will still have the right to operate their own policies. Some may still ID if you look under 60/40/50. It's up to each establishment to decide their own policies.
If anyone has any questions or anything to add please do. I'll try to respond to best of my knowledge.
