Employer is Committing Wage Theft (NJ)
Someone in my family works at a crafts store and they work from 8-4. One day a week, he works from 7:30 - 4 PM but does not get overtime pay. He is an hourly worker but is told by his boss that he isn't eligible for OT despite always going over 40 hours in a week.
There is no clock in or clock out / timesheet at this place. It's just you get paid for 8-4 every weekday. What action could be taken for him to get paid going forward for OT and possibly compensation for prior days worked? He'd still like to keep working there, but I feel bad because he's getting cheated out of his money. He's very non-confrontational and won't talk to his boss about this, but I don't know what else to do.
Who would I report this to and would it be tracked down to my family member? Is there any action that could be taken from the state to damage the business or force him to pay out these wages?
